Age requirement. You must be at least 13 years old to use the Service. The Service is not intended for children under 13.

U.S. users. The Service is intended for users located in the United States. You are responsible for complying with applicable laws and regulations in your location.

Optional accounts. You can use parts of the Service without creating an account (free tier functionality may be available without login).

Account creation. If you create an account, you agree to provide accurate information and keep it up to date.

Login methods. You may sign up using email/password or Google OAuth. Authentication is provided through Supabase.

Account security. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.

Informational tool; not ground truth. Habitat density layers and related outputs may include statistical or machine-learned model results. They are not ground truth, may be incomplete or inaccurate, and may not reflect real-time conditions.

Not for safety, navigation, or legal boundary determination. The Service is not a substitute for official maps, surveys, or legal descriptions; on-the-ground verification; safety planning or navigation tools; or legal advice regarding property boundaries, access, or hunting regulations.

Public land boundaries may be outdated. Public land access/boundary layers (including PADUS-derived sources) may be sourced from government datasets (e.g., USGS) and may not reflect current legal boundaries, closures, easements, or access rules. You must verify independently before entering any property.

You assume risk. You assume all risks arising from your use of the Service, including decisions related to access, hunting outcomes, navigation, weather conditions, and compliance with laws.

Web purchases are processed via Stripe through RevenueCat. iOS purchases are processed through the Apple App Store. Android purchases are processed through Google Play. We do not store your full payment details.

Auto-renewal. Subscriptions auto-renew unless canceled before the renewal date according to the platform where you subscribed (Apple, Google, or Stripe web checkout).

Cancellation. You must cancel through the platform used to subscribe: Apple subscriptions via your Apple ID subscriptions settings, Google subscriptions via Google Play subscriptions settings, or web subscriptions via the web account/billing portal.

Price and feature changes. We may change pricing, features, available species, and plan structures. If a change affects your subscription, we will provide notice as required by the platform and applicable law.

Refunds. Refunds, if any, are handled according to the policies of Apple, Google, or Stripe/RevenueCat (depending on where you purchased). We cannot override app store refund policies.

You own your content. You retain ownership of the waypoint, folder, and preference data you create ("User Content").

License to operate the Service. You grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, transmit, and display your User Content only to the extent needed to provide and improve the Service (for example, syncing your waypoints across devices when you are logged in).

Responsibility for User Content. You are responsible for your User Content, including ensuring it does not violate any law or third-party rights.

Local-only mode. If you use the Service without logging in, your User Content may be stored locally on your device and not uploaded to our servers.

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own lawful, non-commercial use. You may not:

The Service, including its design, text, graphics, layers, compilation, software, and other content (excluding your User Content), is owned by us or our licensors and is protected by applicable intellectual property laws. "10Point" and related marks are our trademarks or trade dress. You may not use them without permission.

The Service relies on third-party services (e.g., Supabase, Cloudflare, Mapbox, RevenueCat, Stripe, Protomaps). Your use of those components may be subject to their separate terms and privacy policies. If you download the app from Apple's App Store or Google Play, you also agree to the applicable platform terms. Apple and Google are not parties to these Terms and are not responsible for the Service.

By you. You may stop using the Service at any time. You may request account deletion as described in our Privacy Policy.

By us. We may suspend or terminate your access if we reasonably believe you violated these Terms, used the Service unlawfully, or created risk or harm to the Service, other users, or third parties.

Effect of termination. Upon termination, your right to use the Service stops. Certain sections that by their nature should survive will survive (including limitations of liability, disclaimers, and indemnification).

The Service is provided "AS IS" and "AS AVAILABLE." We do not warrant that the Service will be uninterrupted, error-free, or fully accurate. We make no warranties regarding the completeness, accuracy, timeliness, or reliability of habitat, wind, boundary, or access information. The Service does not provide legal, safety, surveying, navigation, or professional advice.

Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of (or inability to use) the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the 12 months before the claim, or (b) $100.

You agree to indemnify and hold harmless 10Point from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, your violation of these Terms, or your violation of any law or third-party rights.

These Terms are governed by the laws of the State of Michigan, without regard to conflict of law rules. Unless prohibited by applicable law, you agree that any dispute arising out of or related to these Terms or the Service will be brought in the state or federal courts located in Michigan, and you consent to personal jurisdiction there.

We may update these Terms from time to time. If we make material changes, we will update the "Last Updated" date and may provide additional notice through the Service or on 10point.app. Your continued use of the Service after changes become effective constitutes acceptance.

These Terms and any policies referenced (including the Privacy Policy) form the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of our right to do so later. You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
